Terms of Use

Introduction

These Terms of Use govern access to and use of GetSkipa Image Prep, a browser based image preparation utility provided by GetSkipa LLC. By accessing or using Image Prep, you agree to these terms.

Image Prep is designed to resize, convert, position, crop, compress, and prepare image files for websites, social media, digital products, and other publishing uses. Image Prep is provided as a utility. It does not provide legal, licensing, copyright, publishing, or professional design advice.

If you do not agree to these terms, you may not use Image Prep.

Local Image Processing

Image Prep performs image processing within the user’s web browser during normal operation. Images selected, converted, or prepared through Image Prep are not intentionally uploaded to or stored on GetSkipa servers as part of the image conversion process.

GetSkipa does not maintain copies of processed images and cannot recover, restore, reproduce, or resend files created through Image Prep. You are responsible for downloading, saving, protecting, and backing up source files, imported files, and converted files.

Browser behavior, browser format support, device resources, memory limits, security settings, operating system restrictions, and source application behavior may affect local processing, downloads, previews, available formats, and file creation.

Anonymous Usage Metrics

GetSkipa may collect limited aggregate events to understand whether Image Prep is being discovered, opened, used, and successfully producing downloads. Examples include: landing page views, launch button clicks, converter opens, completed download actions, Help page opens, and Terms page opens.

Metrics are stored as daily totals and are not intended to identify individual visitors. Metrics do not contain image files, image contents, filenames, dimensions, formats, conversion selections, or persistent visitor identifiers.

Metrics collection is intentionally lightweight and is designed to have no meaningful impact on normal image processing or downloads. These totals may be used for product operations, troubleshooting, service improvement, and internal reporting.

User Images and Ownership

You retain any ownership rights you lawfully hold in images processed through Image Prep. GetSkipa does not claim ownership of your images merely because you use the service to resize, convert, position, compress, or otherwise prepare them.

Use of Image Prep does not create, transfer, grant, or confirm any copyright, trademark, publicity, privacy, licensing, or other right in an image. Processing an image does not make an unauthorized image lawful to use.

You are solely responsible for determining whether you own an image, have permission to use it, possess an appropriate license, or are otherwise legally authorized to process, publish, reproduce, distribute, display, sell, or modify it.

Copyright, Trademark, and Intellectual Property Compliance

You may use Image Prep only with images and other materials that you own, are authorized to use, or may lawfully process under applicable law.

You may not use Image Prep to infringe or facilitate infringement of any copyright, trademark, service mark, trade dress, patent, publicity right, privacy right, license restriction, contractual right, or other intellectual property or proprietary right.

You may not remove, obscure, alter, crop, or replace a copyright notice, watermark, attribution, ownership mark, licensing notice, or other rights information unless you have lawful authority to do so.

GetSkipa does not review, monitor, approve, license, verify, or control the images processed by users. GetSkipa is not responsible for copyright infringement, trademark infringement, licensing disputes, unauthorized publication, misappropriation, impersonation, or other unlawful activity committed by a user.

AI-Generated Images

Image Prep processes image files regardless of how they were created. You are responsible for ensuring you have the right to use, modify, publish, sell, or distribute AI-generated images.

You are responsible for complying with the terms, licenses, policies, attribution requirements, and restrictions of the service or model that generated the image.

Using Image Prep does not change the ownership, copyright status, licensing, or permitted uses of an AI-generated image.

Acceptable Use

You agree to use Image Prep only for lawful purposes and in a manner that does not violate the rights of another person or organization.

You may not use Image Prep in connection with any unlawful, fraudulent, deceptive, or abusive activity, or in a manner that infringes the rights of another person or organization. This includes creating, modifying, or distributing material intended to facilitate identity theft, impersonation, harassment, unlawful surveillance, or other illegal conduct.

You may not attempt to interfere with Image Prep, introduce malicious code, misuse browser functions, circumvent security controls, overload the hosted service, conduct unauthorized security testing, scrape the service, or use automated methods that impair access for others.

GetSkipa may restrict, suspend, or discontinue public access to Image Prep if GetSkipa reasonably believes the service is being abused, compromised, used unlawfully, or operated in a manner that creates risk to GetSkipa, its infrastructure, or other users.

User Responsibility and Output Review

You are responsible for reviewing every output file before publishing, distributing, selling, uploading, printing, or otherwise relying on it.

You should verify image dimensions, aspect ratio, cropping, position, file type, transparency, compression, visual quality, text clarity, color appearance, and file compatibility before using an image for an important, public, professional, or commercial purpose.

You are responsible for retaining the source image and any other source material needed to recreate an output. GetSkipa is not responsible for changes in quality, metadata, transparency, color, resolution, orientation, or other image characteristics caused by conversion, resizing, browser behavior, or a source application providing a reduced or converted representation.

Image Metadata

Depending on the source file, selected output format, browser, and browser decoding or encoding capabilities, image metadata may be preserved, removed, modified, or unavailable.

Examples include EXIF, IPTC, XMP, GPS coordinates, camera information, timestamps, orientation data, embedded thumbnails, copyright information, and color profiles.

You should preserve original files separately if metadata matters. Image Prep does not guarantee preservation or removal of every metadata field.

Choosing Image Files imports the file provided by your browser. Dragging files directly from Finder on macOS or File Explorer on Windows also imports the file from that folder. Some photo management applications, such as Apple Photos and similar libraries, may provide a reduced-resolution image when dragging or copying. That behavior is controlled by the operating system or source application, not by Image Prep. Image Prep reports and processes the file it receives.

Image Prep accepts common image inputs when the current browser can decode them. Completed images are exported only in formats the current browser can create and that Image Prep exposes in the output menu.

Bulk Conversion

Image Prep may allow multiple images to be processed together and packaged into a downloadable ZIP file. Bulk conversion uses the saved per-image output settings for each image in the group.

Results may vary when source images have substantially different dimensions, aspect ratios, orientations, transparency, or visual composition. You are responsible for reviewing representative output before processing or publishing a larger group of images.

Image Prep may reject oversized images, oversized batches, unsupported export formats, or excessively large ZIP jobs when needed to protect browser stability. Original Dimensions preserves imported pixel dimensions, not necessarily the imported encoded bytes. Large images, large batches, or large ZIP exports may fail because of browser memory limits, available device resources, browser restrictions, or operating system limitations.

GetSkipa does not guarantee that every image in a bulk conversion will produce an identical visual result or be suitable for the same publishing destination.

Platform Size Information and Third Party Services

Image Prep may provide image dimensions, aspect ratios, format suggestions, and publishing guidance associated with third party platforms, websites, marketplaces, and social media services.

This information is provided for general convenience only. Third party platforms may change their requirements, accepted formats, compression methods, display behavior, safe areas, upload limits, and publishing rules at any time.

You are responsible for confirming current requirements with the platform where an image will be uploaded or published. GetSkipa does not guarantee that a file created through Image Prep will be accepted, displayed correctly, remain unmodified, or satisfy the current rules of any third party platform.

References to third party names, products, or services do not imply sponsorship, endorsement, partnership, affiliation, or approval. All third party trademarks remain the property of their respective owners.

GetSkipa Materials

Image Prep, its interface, source materials, branding, visual design, written content, documentation, icons, and related GetSkipa materials are owned by or licensed to GetSkipa LLC and are protected by applicable intellectual property laws.

These terms grant you permission to use Image Prep for its intended purpose. They do not grant permission to copy, republish, sell, license, misrepresent, remove branding from, or create an unauthorized hosted version of Image Prep or other GetSkipa materials.

You may not use the GetSkipa name, logo, product names, icons, or branding in a manner that suggests sponsorship, approval, ownership, partnership, or affiliation without written permission from GetSkipa LLC.

Service Availability and Changes

GetSkipa may maintain, update, improve, modify, restrict, suspend, or discontinue Image Prep or any feature at any time.

The hosted version may be interrupted by maintenance, browser issues, device limitations, network failures, hosting outages, security events, third party infrastructure failures, or circumstances outside GetSkipa’s reasonable control.

GetSkipa does not guarantee that Image Prep will remain available, continue to support every browser or device, or retain every current feature, preset, format, or workflow.

No Warranty

To the maximum extent permitted by applicable law, Image Prep is provided on an as is and as available basis without warranties of any kind.

GetSkipa disclaims warranties of merchantability, fitness for a particular purpose, title, noninfringement, uninterrupted operation, error free operation, accuracy, compatibility, availability, and suitability for any particular publishing or commercial purpose.

GetSkipa does not warrant that Image Prep will preserve every image characteristic, produce a specific file size, achieve a specific compression result, create a visually acceptable crop, or generate a file accepted by any third party service.

Limitation of Liability

To the maximum extent permitted by applicable law, GetSkipa LLC, its owner, agents, contractors, and affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to Image Prep.

This limitation includes loss of images, loss of files, loss of data, loss of revenue, lost profits, business interruption, publishing delays, rejected uploads, visual defects, quality loss, corrupted downloads, licensing disputes, copyright claims, trademark claims, privacy claims, reputational harm, or unauthorized use of content.

GetSkipa is not liable for claims arising from images you did not own, were not authorized to use, or used in violation of a license, agreement, law, regulation, court order, or the rights of another person or organization.

To the maximum extent permitted by applicable law, GetSkipa’s total aggregate liability for all claims arising from or related to Image Prep shall not exceed the amount you paid directly to GetSkipa for use of Image Prep during the twelve months preceding the event giving rise to the claim. If you paid no fee, GetSkipa’s total aggregate liability shall not exceed one hundred dollars.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, these limitations apply only to the maximum extent permitted by law.

Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless GetSkipa LLC, its owner, agents, contractors, and affiliates from claims, demands, losses, liabilities, damages, judgments, costs, and reasonable legal expenses arising from your unlawful use of Image Prep, your violation of these terms, or your infringement of another person’s intellectual property, privacy, publicity, contractual, or other legal rights.

This obligation applies only to claims arising from your conduct, images, publication decisions, licensing decisions, or use of output files and does not apply to the extent a claim is caused by GetSkipa’s own conduct where liability cannot lawfully be excluded.

Legal Requests

Because images are processed locally during normal operation, GetSkipa generally does not possess copies of the images processed through Image Prep.

GetSkipa may preserve or disclose information it does possess when required to comply with a valid subpoena, court order, law enforcement request, government request, or other applicable legal process.

When legally permitted and reasonably practical, GetSkipa may attempt to notify an affected person before disclosure. GetSkipa may withhold notice when prohibited by law, court order, emergency circumstances, or risk of harm.

Changes to These Terms

GetSkipa may revise these terms to reflect changes to Image Prep, applicable law, security practices, service operations, or business requirements.

Updated terms may be posted with a revised effective date. Continued use of Image Prep after updated terms become effective constitutes acceptance of the revised terms.

Governing Law, Venue, and Miscellaneous Terms

These terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

Any legal action arising out of or relating to these terms or Image Prep must be brought in a court of competent jurisdiction located in Wichita County, Texas, unless applicable law requires another venue.

To the maximum extent permitted by law, you and GetSkipa knowingly waive the right to a trial by jury for disputes arising out of or related to these terms or Image Prep.

If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver of that provision or any other provision.

These terms constitute the agreement between you and GetSkipa regarding use of Image Prep unless a separate written agreement expressly applies.
